Terms of service
1. Scope and Application
These Terms of Service govern all sales of products concluded through the website softlinenliving.my (the "Site") to consumers residing in Metropolitan France. By placing an order on the Site, you confirm that you have read, understood, and accepted these Terms without reservation. These Terms prevail over any other document, including the customer's own terms and conditions.
2. Products and Availability
Products are described and presented on the Site with the greatest possible accuracy. However, photographs and descriptions are for illustrative purposes only and do not form part of the contract. Minor variations in colour, texture, or finish may occur due to screen settings or manufacturing tolerances. Product availability is subject to stock. If a product is unavailable after you place your order, we will notify you by email and offer either a replacement or a full refund.
3. Prices
All prices are displayed in Euros (EUR), all taxes included (TTC). Shipping within Metropolitan France is free of charge. We reserve the right to modify our prices at any time, but the price confirmed at the time of order validation is the price applicable to your purchase. No additional fees will be applied after order confirmation.
4. Order Process and Confirmation
An order is considered confirmed when you receive an order confirmation email from us. We reserve the right to cancel any order in the following cases:
Product unavailability
A manifest pricing error
Suspected fraudulent activity or unauthorized payment
Delivery address outside Metropolitan France
In such cases, you will be notified by email and refunded in full using the same payment method.
5. Payment
Payment is due at the time of order. We accept Visa, MasterCard, and PayPal. All transactions are secured using SSL encryption. We do not store your full payment card details on our servers. Payments are processed by PCI-compliant third-party payment providers.
6. Legal Guarantees
All products sold benefit from the following legal guarantees, independent of any commercial warranty:
Legal Guarantee of Conformity (Articles L217-3 et seq. of the French Consumer Code): You may request repair or replacement of a non-conforming item within 2 years of delivery. If repair or replacement is impossible or disproportionately costly, you may request a price reduction or full refund. This guarantee applies at no cost to you.
Legal Guarantee Against Hidden Defects (Articles 1641 et seq. of the French Civil Code): You may claim a price reduction or full refund if the item has a hidden defect that renders it unfit for its intended use or significantly diminishes its usefulness, provided the defect existed at the time of delivery and was discovered within 2 years of discovery.
To make a claim under either guarantee, contact us at info@softlinenliving.my with your order number and a description of the issue, accompanied by photographs or videos where possible.
7. Liability
We cannot be held liable for delays or failures caused by events beyond our reasonable control, including but not limited to force majeure, carrier strikes, natural disasters, or government actions. Our liability for any direct loss is limited to the amount you paid for the product in question. Nothing in these Terms excludes or limits your statutory rights as a consumer.
8. Intellectual Property
All content on the Site, including text, images, logos, and graphics, is the property of Softlinenliving or its licensors and is protected by French and international intellectual property law. Any reproduction, distribution, or use without prior written consent is prohibited.
9. Applicable Law and Dispute Resolution
These Terms are governed by French law. In the event of a dispute, you may use the free mediation service offered by our consumer mediator or contact the relevant consumer association. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the French courts.
